Australia: Stalker free to teach

What do you have to do to be regarded as dangeous? Kill someone? Is there no requirement for teachers to be of good character?

A high school teacher who was sacked after allegedly sending inappropriate text messages to a female student and who then took revenge by stalking his principal with a series of threatening emails, is free to resume his teaching career. The Queensland College of Teachers was due to fight Robert James Harris's return to work in the Court of Appeal this month, but it has since abandoned the challenge. The decision has cleared the way for Mr Harris, who was initially struck off in 2005, to regain his registration. He was a former physical education teacher at Robina State High School on the Gold Coast.

He came to the attention of police and the Crime and Misconduct Commission and Education Queensland officers in 2002 when a 17-year-old athletics student complained he had sent her abusive text messages after she sought a new coach. She also said she had received messages from Mr Harris with a sexual connotation while he was her coach but they stopped. Mr Harris was never charged over the SMS allegations but was dismissed in 2003 over them and alleged subsequent SMS and written contact with the girl and her family.

Later, he sent multiple threatening emails to his female principal, resulting in a conviction for stalking in April 2005. In one email he told the woman his "life's ambition is now to destroy you and your family"; in another he warned her if he didn't get a job she would "die bitch like me a slow death you ignorant incompetent bitch". Mr Harris, who was sentenced to two years' probation for the stalking but had no conviction recorded, successfully appealed his deregistration in the Brisbane District Court in September last year. Judge Hugh Botting found that while the emails were inexcusable, they were uncharacteristic.

The Courier-Mail yesterday repeatedly requested an interview with Queensland College of Teachers director John Ryan but was told he was unavailable. In a five-line statement, Mr Ryan said the college's board had "reluctantly" withdrawn their appeal after taking "comprehensive legal advice". A spokeswoman from the college declined to answer specific questions about the case yesterday, including whether Mr Harris was currently registered to teach or whether they would be taking any further action. A search of their public register of teachers showed no record of Mr Harris.

Queensland Council of Parents and Citizens Association president Brett Devenish said he believed the average parent would have concerns about the case. "He has legal rights but students have also got a legal right to be safe in their learning environment," he said. An Education Queensland spokesman said Mr Harris was not currently employed in a Queensland state school. He said anyone who applied to teach in a state or non-state school was subject to a rigorous screening process. Mr Harris could not be contacted for comment yesterday.

However, what if the Senior Teacher of 14 years is a person of exceptional character!!!

Why would he get upset and send some choice words to a 'new' Principal; a person he did not really know.

Well, quite simply because he was ignored by everyone after he was dismissed from his job. It took Ed Qld 11 months to make a decision to dismiss the teacher and they were looking for an excuse; in the end they dismissed him because they thought he disobeyed a directive...the fact is there was no directive given by Ed Qld........it was done though Lawyers who did not get the message to the teacher.
The teacher was ignored by E dqld from the time they ulled him out of school and sat him in an Office byself with no work to do for 11 months until he was dismissed....Ed Qld write to him the most degrading letter...and the teacher sits down with the entire CMC report for the 1st time and finds MISTAKES IN THE CMC REPORT and lies TOLD by OFFICERS of ED QLD.....he writes to Ed Qld; to the Premier of Qld, to everyone and he can't afford to go to arbitration...it was going to cost 40,000 he did not have that money...hje had 6 months to go tp arbitration....
He then thought that his local school Principal might read his explanations, rally some support amongst the teachers of which he had a great rapport being a foundation teacher (1996-2003) and the Principla might be able to apppoach Ed Qld...the 6 month period was drawing to a close....still nop answer from everyone...this was his life...teaching was his life....no one had spoken to him since the day he was taken out of school some 18 months; he was ignored and ignored and ignored; and the research tells us that whn this occurs people get angry...and in some cases violent (there is phychological research evidence to back this up); so, the teacher lashes out with a few choice words ......hes not going to kill anyone...in 50 yrs of living he has had the best of characters...he did the same thing to the Premier of Qld and he was satisfied that the teacher was going through a time; but the Principal without warning, just got the police to charge him!!!....she could hve sent a teracher friend around to see him and say, ha I feel uncomfortable gwetting these emails.....and she being a Principal and knowledge of the case should have know the tremendous life's event that the teacher was going through; he was devastatedat losing his whole life ; his job at the peak of his career....

thus, it was because of mistakes in the CMC report and lies told by Officers of e dQld (eg see Attachment 1 - CMC Report - a leaked letter from the Legal advisory Unit, Ed Qld to the CMC stating why the teacher should be taken out of school; all lies....and that can be checked from school records)...they lied to get the CMC involved teacher out of school.
Thus, one might say the Principal overreacted.....this was not a personal attack on the Principal alone.....

The Principal did not interview the teacher before getting the CMC involved.....any reasonable person would have done that; especially when the athlete and parent wanted nothing done about the case.

The Principal did not look after the teachers personal belongings and made it very hard for him to get all his belongings.

Sure, the teacher was genuinely sorry for making the Principal feel uncomfortable but it seems the Principal tried to be a smartarse with it and play the legality to its maximum......it was a shock to the teacher that he was charged....cyber mistermeanors are lumped into staking and as the prosecutor said, it was at the lower end of the stalking charge category....the teacher had no conviction recorded.........
then the College of teacher registration tried to say the teacher is a person of bad character and he had to prove he was a person of exceptional character...the teacher obtained a dozen references from his past from all walks of life to say he was a person of good character.....the Judge saw that this was an extreme out of character case. It is my belief and the belief of Lawyers that this Senior teacher has been dealt with very shabbily by EdQld;
so much for an independent body; the ?College of teachers; the new Director is the same person whop signed his letter of dismissal from Ed Qld.....he left E dQld to take up the Directorship..........a convict of interests.....you bet.....no wonder the QCT tried so hard to have him registered....he must have had a very bad day to say the teacher disobeyed a directive.

Then, the QCT appeal the courts decision and decide to take the matter to the supreme court. Howeve, a week before the case, they pull out on leagal advice.

Obviiously, they did not want to reveal the mistakes in the CMC Report an dlies told by Ed Qld.....

so I dont agree with you topic in this situation.......if anything one should be trying to get thisw teache rback teaching....the poor bastard.........a great and dedicated teacher who got three great references from his work colleagues after he was dismissed; one of which is Mark Blackshaw, now Senior school principal, Varsity College Gold Coast....in no way was there any intent to stalk the Princiapl....but in stalking intent is not an issue....one only has to make someone feel uncomfortable...he was just trying to stick it into the principal for being unreasonable.....

i was always socialised into being reasonable and caring and not ignoring people when they have concerns......she could have warned him or said, one way or the other, look i can help you or I can thelp you but you might like to try this........this did not happen....he was a young bright inexperienced Principal who destroyed someones life by her impulsive ladder climbing attitude and her application of policy above people no matter what the consequenses may be.....even when something was suspected.....why get the cMC involved when one suspects something....anyway, the teacher did the wrong thing...acknowledges it....but, such a rare situation would never occur again...this teacher is no risk to anyone...one of the nicest blokes you would ever meet.....and the athlete herself and the parent have written great references in support of the teacher....so the original complaint was not made y the athlete but by the School or Ed qld......how unusual....???? he was railroaded.......why didn't they just transfer him if they wanted younger teachers?

has full current (2007) registration with the Qld College of Teachers and he has been a member since he first started teaching in 1989.

He is a person of exceptional character and he has helped many students do their best over many years. He is highly respected in the Health and Physical Education and Track and Field areas having attended State and International Conferences and coached athletes to State and National Championships. Mr Harris is a Member of
1. the Australian Council for Health, Physical Education and Recreation (MACHPER)
2. the Australian Track & Field Coaches Association (ATFCA)and
3. the Geography Teachers Association(QGTA).

Mr Harris is no threat to anyone; he has never lifted a hand to anyone in 50 years.....he was just pushed to he limit in a life's event after having been ignored by everyone when there are mistakes in the CMC Report and lies told by an Officer of EdQld...He lost it for a time; it was the end of the arbitration period; he has never been near the person involved; he did not know the person; this was not a personal attack; he did the same thing to the Premier of Qld; he used some not so choice words towards the person.
